Terms and Conditions

These terms are an agreement between you and Tsumida AI, of Toronto, Ontario, Canada. They cover every app and website we make, and the Tsumida AI account they share. Some apps have their own terms (for example Peel, Koko Travel and our games). Where an app has them, they add to these terms for that app, and they win where the two differ.

By using one of our apps or websites, you agree to these terms. If you do not agree, please do not use them.

Using our apps

We give you a personal, non-exclusive, non-transferable licence to use our apps on devices you own or control, for your own non-commercial use, as these terms allow. You must be at least 13 years old (or the minimum age in your country) to make an account, and if you are under 18, you need a parent's or guardian's permission.

Your account

One Tsumida AI account works across all of our apps. Keep it secure and let us know if you think someone else has used it. You are responsible for what happens under your account. You can delete it at any time, as the privacy policy describes.

Your content

What you make or put into our apps is yours. When a feature needs to send something to our servers (for example to share it with a friend or sync it across your devices), you give us permission to store, process and show it, only as needed to provide that feature to you and to the people you chose. That permission ends when you delete the content or your account, except for copies other people already received from you.

Only put in what you have the right to use, and be respectful of other people when you share something about them.

What not to do

break the law, or help someone else break it;
harass, threaten, impersonate or spam anyone, including through invitations or sharing;
upload anything that is illegal, infringes someone else's rights, or contains malware;
try to get into accounts or systems that are not yours, or overload or disrupt our services;
scrape, copy, resell or reverse engineer the apps, except where the law allows it.

If you do, we may remove the content, or suspend or close the account.

AI features

Some features use AI to produce results, such as reading a link or suggesting a plan. AI can be wrong, incomplete or out of date. Check anything important yourself (opening hours, prices, bookings, directions, translations) before you rely on it, and never rely on it for medical, legal, financial or safety decisions.

Purchases and subscriptions

Purchases and subscriptions are made through the App Store or Google Play, and their terms cover billing, renewals and refunds. Prices are shown in the store before you buy. A subscription renews until you cancel it in your store account settings. Refunds are handled by Apple or Google under their own rules. Coins, lives and other in-app items have no cash value and cannot be exchanged for money. A purchase that can be restored is restored through Restore purchases in the app.

Other services

Our apps may link to, or work with, services we do not run, such as maps, booking sites, or Apple's and Google's sign-in. Their own terms apply to them, and we are not responsible for them.

Our stuff

The apps, their names, logos, artwork, music and code belong to Tsumida AI or to those who license them to us. These terms do not give you any right to use them beyond using the apps.

Feedback

If you send us ideas or suggestions, we may use them freely, without owing you anything.

Changes and ending

We may change, add or remove features, or stop offering an app. You can stop using our apps at any time. We may suspend or close an account that breaks these terms. If we change these terms, the new version will be posted on this page with a new date, and if you keep using the apps after that, the new terms apply.

No warranty

The apps are provided "as is" and "as available". We work hard to make them good, but we do not promise they will always be available, free of bugs, or right for your needs. Keep your own copies of anything that matters to you.

Limit of liability

To the fullest extent the law allows, Tsumida AI is not liable for any indirect, incidental, special or consequential loss, or for lost data, profits or opportunities, arising from your use of our apps. Our total liability to you for any claim is limited to the amount you paid us for the app concerned in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be waived.

Apple

If you got an app from the App Store, these terms are between you and Tsumida AI, not Apple. Apple is not responsible for the app, its maintenance or support, or any claims about it. If the app fails to meet a warranty, you may tell Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Toronto, Ontario, unless the law where you live gives you the right to bring them where you live.
